PREPARING & PRESENTING YOUR CASE AT THE CCMA OR BARGAINING COUNCIL

This course enables you to understand the basis for CCMA referrals. CHAIRING DISCIPLINARY HEARINGS

The course covers the selection of the chairperson, their role, dealing with preliminary objections raised by either party, the process the chairperson must follow including checking the employee’s rights have not been infringed, the pleading process and evidence issues. The course examines the issues of objections raised during questioning of a witness, the standard of proof required, how to weight evidence, how to analyze the different elements of misconduct. We look at how to draw the correct conclusions from the evidence so as to make a finding and how to determine the correct sanction for the guilty finding. We use practical examples for drafting the chairman’s report and do a role-play of a hearing. We examine the difference between the roles of a chairperson in a disciplinary hearing and an incapacity hearing. An effective chairperson is your failsafe against a procedurally or substantively unfair dismissal case.
